Why Arizona Investors Need High Liability Coverage

Most investors understand that liability coverage is important, but that doesn’t always mean they understand why. As a property owner, you are ultimately responsible for what happens at the homes you own. That responsibility goes beyond rent collection and maintenance; it includes exposure to personal liability if someone is injured on your property.

For example, let’s say your tenant owns a dog. If that dog bites someone, the injured party will likely attempt to sue the tenant first. The argument may be that you knew there was a potentially dangerous animal on the premises and allowed it to remain there. That opens the door to serious bodily injury claims, and those lawsuits can quickly become expensive.

Many landlord policies include $500,000 in coverage for property damage liability and injury claims. While that sounds like a large amount, dog bite cases alone can settle for well over a million dollars depending on the severity of the injury.

A Pennsylvania jury awarded $11.6 million to a college student who became paralyzed after falling more than 20 feet through a poorly covered skylight at an off-campus rental property, finding the owner liable under premises liability law. The case highlighted that property owners and landlords can be held responsible for unsafe conditions on their property, even when the injured person was not a tenant. This type of claim shows how quickly liability exposure can escalate into a major payout when hazardous conditions are not properly addressed. 

Many investors respond with, “I’m protected,  I have an LLC.” But legal structures are not bulletproof. Courts can sometimes pierce corporate protections under certain conditions, especially if procedures weren’t followed precisely. It’s always wise to speak with an attorney about your specific situation.

The core takeaway is simple: not all property lawsuits are rooted in logic. Strong liability coverage,  and limits high enough to withstand severe bodily injury claims  is one of the most important protections a rental property owner can put in place.
